ParkedAuto Website Privacy Policy

1. Overview

We are committed to protecting personal information provided by everyone with whom we do business. This Privacy Policy provides details about how OD Technologies Inc. (“OD Technologies,” “we,” “us” or “our“) collects, uses, discloses and otherwise processes personal information in connection with the operation of the ParkedAuto website, www.parkedauto.com (the “ParkedAuto Website“). As used in this Privacy Policy, “personal information” means information about an identifiable individual.

Please note that the ParkedAuto Website may contain links to other entities’ websites that are not controlled or operated by us. This Privacy Policy does not apply to such third-party websites, and we are not responsible for the content of such third-party websites or the privacy practices of such third parties. We encourage you to request and review the privacy policies of any third parties upon visiting such third-party websites or upon disclosing your information to such parties.

2. About the ParkedAuto Website

The ParkedAuto Website operates in conjunction with the ParkedAuto mobile application (the “ParkedAuto App“).

The ParkedAuto App connects individuals and dealerships for motor vehicle repair and maintenance (the “Services“). ParkedAuto App users (each a “User“) input information about their motor vehicle, location and Service needs into the ParkedAuto App. The ParkedAuto App then uses this information to provide Users with options of dealerships within a geographic range that can provide the Services (“Merchants“). Thereafter, the ParkedAuto App facilitates the pick-up, servicing and drop-off of the motor vehicle and payment for the agreed-upon Services between Users and Merchants.

The ParkedAuto Website provides another means through which Merchants can access the information provided by Users in the ParkedAuto App and facilitate the provision of the Services to Users.

3. The Information We Collect

We collect certain information about Merchants through the ParkedAuto Website. Such information includes Merchant business name, Merchant business address, photo of Merchant business or proprietor, Merchant business phone number and email addresses, hours of operation, names and photos of Merchant employees and representatives and information about Merchant categories of products sold by and their price and availability. We also collect such information from Merchants through the ParkedAuto App.

All personal information about Users is collected through the ParkedAuto App.

4. How We Use the Information We Collect

We use the information we collect from Merchants and Users for several seasons. We primarily use this information to connect Merchants with Users and to enable Merchants to provide the Services to Users. We also use this information to:

• provide and administer the ParkedAuto Website;
• communicate with Users and Merchants regarding the ParkedAuto Website and different promotions;
• respond to requests and inquiries;
• develop, improve, and refine the ParkedAuto Website;
• troubleshoot issues and measure the performance of the ParkedAuto Website;
• manage and administer our business, including to detect and prevent against error and fraud and enforce our agreements with Users and Merchants; and
• otherwise with User and/or Merchant consent or as permitted or required by law.

5. Disclosure of Information

We may transfer personal information to service providers (including affiliates acting in this capacity) that provide services on our behalf such as data hosting and processing, marketing, analytics and payment processing.  We require our service providers to use personal information only as necessary to perform the services we have hired them to provide.

We may also use and disclose personal information to parties connected with the proposed or actual financing, insuring, sale or other disposal of all or part of our business or assets, for purposes connected to evaluating and performing the transaction. Our successors and assigns may use and disclose personal information for the purposes described in this Privacy Policy.

We may disclose personal information in other circumstances with consent, to enforce our rights or agreements, to collect amounts owing to us, or where otherwise permitted or required by law.

6. Legal Basis for Processing

We process personal information with consent except where otherwise permitted or required by law.  For example, we may be permitted to collect, use or disclose personal information without consent in order to collect a debt owed, to comply with a subpoena or court order, or to comply with the rules of court regarding the production of records.  Consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question. We rely on Users to obtain consent from Merchants on our behalf.

Where personal information is processed with consent, individuals may (subject to contractual and legal restrictions) refuse to provide consent, or choose to withdraw consent, to our processing of personal information by contacting us at customerservice@parkedauto.com. Note that if an individual refuses consent, or withdraws consent, to certain processing of personal information, we may not be able to provide certain of our services.

7. Security and Retention

We have implemented reasonable physical, organizational and technological security measures to safeguard the personal information in our custody or control. These measures include safeguards to protect personal information against loss or theft, as well as unauthorized access, disclosure, copying, use, or modification. It should be noted, however, that absolute security is not possible, and we therefore make no warranties as to the security of personal information.

Personal information is retained for only as long as needed to reasonably fulfill the purposes for which it was intended and for legal or business purposes. Personal information that is no longer required is destroyed using secure means, including shredding paper records and permanently deleting electronic records.

8. Storage and Processing

The ParkedAuto Website is based in Canada. Our service providers are based in Canada and Oregon. We require that all our service providers maintain privacy protections that are equivalent or substantially similar to those outlined in this Privacy Policy. By using the ParkedAuto Website, Users acknowledge and agree that their personal information may be processed and stored outside of Canada.

Please note that personal information will be subject to applicable foreign laws while it is being stored or processed in such country, which may permit government and national security authorities to access information in certain circumstances. 9. Cookies and Other Tracking Technologies

We may use cookies and other tracking devices on the ParkedAuto Website. Cookies are small data files that are sent to a browser and placed on the computer’s hard drive when a website is visited. The use of cookies allows us to measure website activity and we may use third parties to serve our advertisements on other websites.  In serving our advertisements, these companies may use cookies and other tracking devices to collect certain information about your visits to other websites.  This information may be used to evaluate our online advertising campaigns or to tailor promotions and other marketing messages to you.

10. Access, Correction and Other Rights

Individuals have the right to request access to their personal information in our custody or control. We will make every reasonable effort to provide access to your personal information if you request such access in writing to customerservice@parkedauto.com. In some circumstances, we may not provide access to personal information. In the event that access is refused, we will provide reasons for the refusal, the name of the person who can answer questions about the request and advise of the right to have the decision reviewed by the applicable authority.

We use commercially reasonable efforts to ensure that personal information in our possession is accurate and complete. If you are aware of an error in personal information about you that is under our control, please let us know and we will correct it on request whenever possible. In some cases, we may ask for a written request for correction.  We may also take reasonable steps to verify your identity before granting access or making corrections.
